The LONE STAR SHUTTLE OF KATY platform, meaning by such platform: the website, the mobile application App, the WhatsApp chatbot, the email or its telephone service, and/or its set of tools such as transport booking methodologies, reports, social network profiles, among others, is owned by the company LONE STAR SHUTTLE OF KATY LLC (hereinafter, all of them referred to as LONE STAR), in the Houston, Texas area. This company aims to be a luxury individual or group transportation service provider. To achieve this, it provides its service on behalf of its own fleet of vehicles or through vehicles from other companies.

The general terms and conditions of use and the privacy policies contained in this clause apply both to the LONE STAR website (https://www.lonestarsk.com ) as for a possible mobile application and/or for the chatbot on WhatsApp and other products or services bearing the same name. They are aimed at their USERS, meaning anyone who books or uses their services, regardless of the role or quality of actor they hold.

For these purposes, it is warned that, in the terms of the applicable legislation, the services offered by LONE STAR may be reserved by persons of legal age in www.lonestarsk.com and borrowed in the State of Texas.

“LONE STAR” reserves all of its intellectual property rights in the Services. The trademarks and logos used in connection with the Services are the trademarks of their respective owners.

Please read the following clauses carefully before using the LONE STAR platform, as their use is subject to the general terms and conditions of use and the privacy policies set out below, understanding that these are the terms of a legal contract between USERS and LONE STAR. By accessing, browsing, downloading or using any of the LONE STAR platforms, you acknowledge that you have read this clause, that you have understood it and are therefore obliged to comply with the following terms and conditions as an indispensable requirement to enjoy the services offered through LONE STAR. For any link between users and LONE STAR, these Terms and Conditions will always prevail.

Your access to the services offered by LONE STAR implies that you fully accept the content of these terms and conditions; if you do not agree with any of these terms, we invite you to inform us of it in writing and to refrain from using any of our services.

General description of activities

LONE STAR has conceived the provision of the following services:

Provision of luxury individual transportation service for passengers, by direct operation or through an alliance with third-party companies.

Reservations for the service can be made through our website www.lonestarsk.com there you will find the types of vehicles.

The service fees are calculated by the web platform when you indicate the date, place and time data. If you want to check the detailed prices of the service you have booked you can contact: commercial@lonestarsk.com indicating the data corresponding to the service.

Payment methods

The services provided by LONE STAR may be paid by bank card through the payment gateway outsourced to the company CLOVERGO whose link is on the website (LONE STAR may change payment gateways without prior notice, only the link of the payment partner will be updated). The claims corresponding to the payment method will be handled directly by your financial institution or by the CLOVERGO payment platform. LONE STAR will not store or request any validation data from your bank card. LONE STAR is not part of the validation process of the ownership of the bank account, nor who uses the payment method.

Additional payments will also be received in cash or by dataphone by our drivers if required.

GENERAL CONDITIONS OF USE

  1. User

To access the services of LONE STAR, and in accordance with these terms and conditions in which the general rules of use are detailed, you may fill in the data corresponding to the type of service, place of collection and destination, and time of service. The creation of a user account is not required, but some minimum data is required so that the service can be provided; if by decision of LONE STAR it is considered that a user must be created for the provision of the service, such situation will be indicated in the corresponding section of the website.

The user must request the service in his/her own name (according to his/her ID) and must be of legal age; in the event of doing so so that it is a third party who is traveling, he/she must indicate the corresponding data, validating his/her kinship in the case of being a minor.

Minors under the age of 16 may travel unaccompanied with the express consent of a responsible adult or legal guardian, we assume that if it is a minor of this age, the respective authorization of the parents or guardian is available. To use the Services, you agree that: (1) you are at least the “Minimum Age” within the state of Texas; and (2) you will need to apply for the LONE STAR service, under your real name. The request for a service with false information or that does not correspond to the passenger, constitutes a violation of our Terms.

In order to use LONE STAR, you agree to provide and update the minimum information required to access the services, and enable LONE STAR to store, analyze, use and process your registration data. However, if the USER decides to disable their account, LONE STAR will store their information for the term indicated by the personal data protection regulations.

For the confirmation of a service, you can send an email to the email entered, or SMS to the cell phone number indicated by you at the time of booking in order to verify the veracity of the shared data.

  1. General rules of use and obligations of the user

2.1. Guarantee that the information provided for the request of the transport service is truthful and that You are the owner of this. The driver may request the user or any passenger to indicate their age.

2.2. Comply with the traffic rules in terms of what corresponds to your role as a passenger. The service is provided under conditions of standards that allow for safety and optimal driving; therefore, the volume of music or dialogue should not impede the driver’s concentration.

2.3. Refrain from consuming psychoactive substances inside the vehicle or engaging in offensive behavior in terms of disrespect to the driver, passers-by or any third party.

2.4. Refrain from transporting in the vehicle substances or elements prohibited by Texas law or that endanger the integrity of the driver, the vehicle or third parties. We are not responsible for the abandonment of items for personal use.

2.5. All hot alcoholic or non-alcoholic beverages must be in a closed container (No open container). Smoking is not allowed in the vehicle nor the use of vapes will lead to the imposition of the penalties indicated below.

2.6. It is not the driver’s obligation to allow the mobile device connectivity of the service applicant or another passenger for the purpose of listening to music.

2.7. Comply with the stipulations of the other clauses provided for in these terms and conditions and refrain from making the following improper uses:

– Provide false or incorrect data that may mislead LONE STAR or third parties, whether they are USERS or not. In case this happens, LONE STAR reserves the right to reject, block or delete the information that is provided in contravention of the indicated in point;

– Infringe, in whole or in part, any intellectual property content that is part of LONE STAR or its allies, such as, but not limited to copyright, trademarks, invention patents, industrial designs, trade and industrial secrets, privileged information, or confidential information.

– Perform acts that may intentionally interfere with the services offered by LONE STAR.

The agreement between LONE STAR users is governed exclusively by these terms and conditions, and LONE STAR does not recommend the constitution of other agreements, with the drivers of the vehicles, that are different from this document, in order to have equal conditions between all users.

  1. Intellectual Property

LONE STAR is the owner or authorized person regarding the intellectual and industrial property rights on the LONE STAR platform, the Mobile App, chatbot, as well as the contents or industrial and intellectual property rights that are incorporated therein, including the technological platform, methodologies, digital tools, distinctive signs (trademarks or others), designs, codes, working methods, procedures, industrial secrets, information systems, know-how, drawings, texts, databases, videos and other complementary contents to the development called LONE STAR. The distribution, copying, adaptation or use of any of these contents, outside of what is indicated in these terms and conditions without the prior written authorization by a legal representative of LONE STAR, whatever its purpose, is prohibited.

Specific rules of intellectual property:

3.1. The computer, advertising, photographic, graphic, multimedia, audiovisual and design material, as well as all the contents, texts and databases made available on this site are the property of the person who uploaded them, or in some cases, of third parties who have authorized their use and / or exploitation. LONE STAR will be able to use the data to achieve the objective, performing analyses, reports, Insights.

3.2. The contents published by LONE STAR on the website, chatbot and Mobile Application are protected by Copyright regulations and by all national and international regulations applicable to it. Any act of copying, reproduction, adaptation, modification, creation of derivative works, sale or distribution, exhibition of the contents published by LONE STAR is prohibited. In no case do these Terms and Conditions confer on the visitors of the page or the users of the Mobile Application, rights, licenses, or authorizations to perform the previously prohibited acts; if derivative contents are generated by third parties, LONE STAR is not responsible for the use that unauthorized third parties give on the information.

3.3. Any unauthorized use of the contents will constitute a violation of these Terms and Conditions and the current rules on copyright and any other that may be applicable.

The violation of any of the rights and limitations indicated in this clause by the USER will enable LONE STAR, without prior communication or notice, to proceed with the immediate cancellation of the USER account unilaterally.

  1. Rights of third parties

LONE STAR, through its web platform or the mobile application, may offer information about services that will be offered by third-party companies, or by LONE STAR itself, which will be subject to these Terms and Conditions.

LONE STAR will provide the information that is required by official authorities in the event that data associated with the provision of its services is requested.

  1. Disclaimer of liability

LONE STAR, in addition to the cases already indicated, is not responsible for the information, regardless of its content, that third parties share through its web platform or mobile application. In particular, LONE STAR is not responsible for the following cases:

5.1. When the USER provides false information or from third parties of which he does not have authorization.

5.2. When the USER uses the transport service for purposes that go against morality and good customs and / or to the detriment or affectation of third parties in cases such as: harassment due to politics, gender discrimination, religion, disability, physical appearance, among others.

5.3. When the USER shares personal data of third parties without their authorization.

5.3. When there are situations of fortuitous event or force majeure that prevent the service from being provided as:

– Natural events that put the integrity of the driver and/or the vehicle at risk such as storms, hurricanes, tornadoes, earthquakes, or floods. National or international public health situations such as pandemics, endemics and/or severe viral spreads announced by any Government agency.

– Fires within a radius of 2 miles from the place of service provision.

– The occurrence of an act of disturbance to public order such as protests, asonadas, shootings within a radius of 2 miles from the place of provision of the service.

PARAGRAPH 1: In the event of any difference between telephone or verbal agreements between the parties and these Terms and Conditions, the provisions of this document must be interpreted as taking precedence.

PARAGRAPH 2: LONE STAR is not responsible for the permanence and availability of the platform, chatbot, mobile App, or the information contained therein, either due to being a victim of a computer attack, by periodic deletion processes, or by unilateral decision; the foregoing excepting the information that due to contractual or legal commitments must be stored.

  1. Technical requirements for the user experience

In order to make proper use of the platform, application, chatbot or the website, the USER must have the following technical requirements:

Connectivity to the public Internet network Connected device. Web browser compatible with HTML5 and 128bit security certificates JavaScript and CSS enabled in the browser Minimum screen resolution of 1024 x 768 pixels for desktop, 640×480 for mobile devices.

  1. Arbitration clause

Commercial (U.S. domestic) – Any controversy or claim arising out of or relating to this contract, or the breach thereof, shall be settled by arbitration administered by the American Arbitration Association in accordance with its Commercial

  1. Penalties

CANCELLATION: Taking into account that once a reservation is made with LONE STAR, the company must designate drivers and make a vehicle available to the user at a certain time, the company will only charge the cancellation fee according to the type of service, zone and time, no other additional thistle will be taken into account.

CLEANING FEE: If a vehicle user carries out a behavior that involves cleaning the vehicle, either by bodily fluids, by spilling drinks or food, LONE STAR will be entitled to charge the user with the costs of washing the vehicle. If the person smokes or uses vaporizers in the service, he will have to pay a fine.

– Smoking or vaping in the vehicle will cost: Cleaning fee

– Vomiting in/on the vehicle will cost: Cleaning fee

– Trashing the vehicle will cost: Cleaning fee

USD$125. In any type of vehicle for the above-mentioned cases.

WAITING TIMES: In the events that exceed the waiting times the following rates will be applied depending on the type of service and location:

Luxury Sedan: USD$22

Luxury SUV: USD$27.5

Ford Sprinter Lux: USD$33

And the waiting costs will be applied as follows

– Waiting time exceeding 30 minutes for domestic flights

– Waiting time exceeding 45 minutes for international flights

– Waiting time exceeding 15 minutes for any other location

OTHER SITUATIONS:

Damage Report: The driver must report any damage to the vehicle to Lone Star within 24 hours of its occurrence. The report should include:

– Detailed description of the damage

– Photographs and/or videos of the damage

– Date and time when the damage occurred

– Location where the damage occurred

Notification to the User: Lone Star will notify the user who made the reservation and generated the payment about the damages reported by the driver, within a maximum period of 72 hours.

Debiting of Charges: In case it is determined that the driver is responsible for the damages, Lone Star will automatically debit the cost of the repair from the means of payment registered in its database.

– The driver holds the right to terminate the job if passengers engage in illegal or dangerous activity.

– Clients under the age of 21 are not allowed to have alcoholic beverages in the vehicle. If the driver finds alcohol in the vehicle, the job will be terminated and the parents will be notified topic up the group, and the money will not be refunded.

– The Guarantor/Renter approve LONE STAR to charge for any damages that mayoccur by the Guarantor/Renter and/or his/her guests as followed:

– Broken, burns, marks, any holes or cuts in the seats will cost $400 per cut or hole.

– Broken or missing Roof Emergency Exit will cost $600.

– Broken or cracked windows will cost $600 per damaged window.

– Any other damage will be determined by the case of the damage.

  1. Domicile and applicable legislation

For all legal purposes, the place of performance of the obligations arising from these terms and conditions is stipulated as the state of Texas, USA. And in particular by the mobility regulations of the City of Houston https://www.dps.texas.gov/internetforms/forms/dl-7s.pdf

This regulation of the United States will even be applicable if the users are located in or come from different territories.

On the other hand, services to and from the Houston Airport are regulated by the “Houston Airport Code” https://www.fly2houston.com

  1. Termination

For all legal purposes, the relationship between a user and LONE STAR may be terminated:

– At the end of the provision of the service.

– At the time of canceling the service, prior to the fulfillment of the obligations to which, according to their relationship with the company, they are in force, such as covering cancellation fees.

– On the other hand, if LONE STAR is obliged by legal provision or by an agreement between its partners or allies to suspend or terminate its operation, it may unilaterally terminate the provision of its services by reimbursing the corresponding reservation and without being obliged to pay any penalties to its users.

  1. Cyber security

In compliance with that NIST Cybersecurity Framework, LONE STAR has incorporated best practices to identify, protect, detect, respond to and recover from cybersecurity incidents by creating adaptable benchmarks and recommendations to mitigate cyber activities penalized by U.S. laws, such as:

* Computer hacking.

* Identity theft.

* Economic espionage.

* Theft of trade secrets.

* Breaking into computer systems and accessing, modifying or deleting data;

* Theft of confidential information.

* Malicious alteration of Internet websites; and

* Affecting websites with large volumes of irrelevant Internet traffic to make websites unavailable to real customers.

Acting by voluntarily complying with the National Institute of Standards and Technology’s (NIST) Cybersecurity Framework, LONE STAR incorporates international benchmarks as examples of best practices to help U.S. companies manage and reduce cybersecurity risks. Such are the data encryption that provides a safe harbor for the company in order to mitigate the risks in case of a data security breach.

  1. Artificial Intelligence

LONE STAR is not responsible for any content generated by an artificial intelligence system, including, but not limited to, text, images, audio and video.

LONE STAR is not responsible for the accuracy, veracity, integrity or reliability of the Artificial Intelligence Contents. The Contents of Artificial Intelligence are generated from algorithms that may contain biases or errors and cannot be considered as a substitute for human judgment.

The User is solely responsible for the interpretation and use of the Artificial Intelligence contents published or to be published on the platform. LONE STAR is not responsible for any damage or harm that may arise from the use of Artificial Intelligence Contents.

  1. Validity and modification of terms and conditions

These terms and conditions are effective as of the date of their publication, on April 01, 2024. However, LONE STAR reserves the right to make, at any time and without prior notice, updates or modifications to these terms and conditions in response to the requirements that may arise, internal or external, for the correct provision of its services.

Any modification or update will imply the ability to add or delete information and will be published or made available to USERS through any of the following channels: the website, the mobile application, e-mail (understood as the last one provided), or visible advertisements in any of the above or attention centers. With this, the USER will be able to decide whether to continue using the services offered by LONE STAR.

This website includes notices about its own and third-party services and products, the terms of which must be observed and followed. No content of this platform may be copied, reproduced, adapted, collected, uploaded, published, transmitted, distributed, or used without the prior and express consent of LONE STAR or its owner.
